§ 130.108 DRIVING UNDER THE INFLUENCE OF MARIJUANA.
   A person commits the offense of driving under the influence of marijuana if he or she operates a motor vehicle under the influence of marijuana. Provided however that the presence of marijuana in the defendant's system alone shall not be sufficient proof that the defendant was under the influence of marijuana.
