§ 31.25 TERMS FOR COUNCIL MEMBERS AND CLERK-TREASURER.
   If a Town Convention is held in 2015 for only one political party, no write-in nominees are named for any town office, and the Benton County Election Board passes a resolution pursuant to I.C. 3-10-7-6(e) in 2015, the results of the 2015 Town Convention shall serve as the results of the municipal election for the town, and the terms of the elected officials shall be as set forth herein. Further, any unopposed candidate for office shall be deemed elected to that office as set forth herein.
   (A)   The Town Clerk-Treasurer nominated in the 2015 Town Convention, if unopposed, shall be deemed elected and shall serve a term of office of three years.
   (B)   Three members of the Town Council nominated in the 2015 Town Convention shall be deemed elected for a term of office of three years. These three members shall be identified as those individuals receiving the highest vote totals in the 2015 Town Convention.
   (C)   Two members of the Town Council nominated in the 2015 Town Convention shall be deemed elected for a term of office of one year. These two members shall be identified as those individuals receiving the fourth and fifth highest vote totals in the 2015 Town Convention.
   (D)   All successors to the town officers elected at the municipal election in 2015 shall serve for terms of four years.
   (E)   The term of office of each town officer begins on January 1 after the election.
   (F)   In the event of a tie vote between two or more candidates for the Town Council in the 2015 election receiving either the third highest number of votes or in the event there is no election under I.C. 3-10-7, the candidates shall draw lots to determine which candidate shall serve a term of three years as opposed to a term of one year.
