(A) The town may terminate or cause to be terminated wastewater service if a violation of any provision of this chapter or the major contributor permit is found to exist or if a discharge causes or threatens to cause a condition of pollution or nuisance as defined in this chapter or causes the town to violate the terms of its NPDES Permit No. IN-0023990. This provision is in addition to other statutes, rules or regulations authorizing termination of service for termination of service for delinquency in payment.
(B) Any user affected by any decision, action or determination, including cease and desist orders made by the Superintendent, interpreting or implementing the provisions of this chapter, or any permit issued herein, may file with the Superintendent a written request for reconsideration within ten days of such a decision, action or determination, setting forth in detail the facts supporting the user’s request for reconsideration.
(C) If the ruling made by the Superintendent is unsatisfactory to the person requesting reconsideration he or she may, within ten days from the notification of the Superintendent, file a written appeal to the Town Council. The written appeal shall be heard by the Town Council within 30 days from the date of filing. The Town Council shall make a final ruling on the appeal within 15 days of the close of the meeting. The Superintendent’s decision, action or determination shall remain in effect during such period of reconsideration.
