§ 174.24 KEEPING DOWN WEEDS.
   Section 93.40 of the Ohio Basic Code is amended to read as follows:
   (A)   Any person owning or having charge of land within the municipality shall keep such property free and clear from all grass, noxious weeds and rank vegetation in excess of eight inches in height. The person owning or having charge of land abutting a public right-of-way shall also have the responsibility to cut and remove all grass, noxious weeds and rank vegetation in excess of eight inches in height on the abutting right-of-way.
   (B)   Noxious weeds and rank vegetation shall include but not be limited to:
      (1)   Any weeds such as the following:

      (2)   Grapevines when growing in groups of 100 or more and not pruned, sprayed, cultivated, or otherwise maintained for two consecutive years;

      (3)   Bushes of the species of tall, common, or European barberry, further known as berberis vulgaris or its horticultural varieties;
      (4)   Any weeds, grass, or plants, other than trees, bushes, flowers, or other ornamental plants, growing to a height exceeding eight inches.
   (C)   Any land in the Village of Ottawa Hills that is larger than 15 acres or any land that is predominantly wooded or is maintained in its natural state is exempt from the provisions of this section.
