§ 176.40 POINTING AND DISCHARGING FIREARMS AND OTHER WEAPONS.
   Section 137.09 of the Ohio Basic Code is amended to read as follows:
   (D)   Hunting.
      (1)   No person shall hunt or kill game as defined by R.C. § 1531.01 in the corporate limits of the village unless such activity is specifically authorized by the Village Council as part of a controlled bow hunting program intended to control the white tail deer population. Such a controlled bow hunting program shall include:
         (a)   A requirement that hunting and killing white tail deer within the village shall be governed by the applicable laws and regulations of the State of Ohio, and ordinances and regulations of the village.
         (b)   A requirement that the State of Ohio provide approval to the village authorizing any such bow hunting program.
         (c)   A restriction that any program shall be limited to bow hunting only.
      (2)   Any person who has received written authorization from the village to hunt or kill game as part of an approved bow hunting program shall be exempt from the prohibitions described in division (E) of this section, as amended, while actively participating in any controlled bow hunting program authorized herein.
      (3)   Whoever violates division (D)(1) of this section is guilty of a misdemeanor of the fourth degree.
   (E)   Unlawful discharge. No person shall discharge any BB gun, air gun, airsoft gun, paintball gun or firearm, or make use of any sling, bow and arrow, or crossbow, within the corporate limits of the municipality.
