(A) License required. No person shall possess, use, or explode any fireworks as defined in M.S. § 624.20, as it may be amended from time to time, without a permit or license therefor.
(B) Application. Every application for this type of license shall be in writing to the Administrator-Clerk-Treasurer at least 15 days in advance of the date of any fireworks display. The application shall be promptly referred to the Fire Marshal, who shall make an investigation to determine whether the operator of the display is competent and whether the display is of a character and is to be located, discharged, or fired so that it will not be hazardous to property or endanger any person. The Fire Marshal shall report the results of this investigation to the Administrator-Clerk-Treasurer, and if the Fire Marshal reports that the operator is competent and that the display as planned will conform to safety requirements, including the rules and regulations of the State Fire Marshal, the Administrator-Clerk-Treasurer shall issue a license for the display.
(C) Fee. The license shall not be issued until a fee, as set by Council resolution, has been paid.
