§ 90.99 PENALTY.
   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code of ordinances.
   (B)   (1)   Any person, resident, or owner who allows his or her dog, cat, or other animal to run at large, and not under restraint, shall be subject to a fine of $25 for the first occurrence, $50 for the second occurrence, and $100 for the third occurrence.
      (2)   Any animal impounded under the terms of this subchapter may be re-claimed by its owner or owner’s agent upon the payment to the Clerk-Treasurer the sum of $10 for each animal so impounded, together with an additional fee of $3 for each day or part thereof that such animal is impounded, and payment of any fees for veterinary services and actual charges incurred by the town for such impoundment.
      (3)   The Clerk-Treasurer shall deposit the aforementioned sums so collected in the General Fund.
   (C)   (1)   A person who violates any provision of § 90.10 shall be liable for all reasonable and customary expenses incurred by the town resulting from the violation, including but not limited to reimbursement for food, board, euthanasia, or disposal of the animal, in addition to any penalties set forth below.
      (2)   A person who violates this chapter may be fined up to $1,000 for each offense. A separate offense shall be deemed committed on each day that a violation occurs or continues.
      (3)   Nuisance violations may be enjoined or abated and fined as set forth above.
   (D)   (1)   Whoever violates § 90.11 shall, upon conviction, be punished with a minimum fine of $10 for the first violation, $25 for the second violation within a three-month period and $100 for the third violation within a six-month period, and a maximum fine of $250 and costs, with each day that the violation continues being a separate offense which shall subject the violator to a separate fine.
      (2)   Restraining order and/or injunction. In addition to the foregoing, the town is empowered to obtain a restraining order and/or permanent injunction against any person, firm, corporation or any other entity that shall be in violation of this section.
