§ 34.04 POWERS AND DUTIES OF THE COMMISSION.
   (A)   The Planning Commission shall have the powers and duties given planning agencies generally by law. The Commission shall also exercise the duties conferred upon it by this chapter and by the Council.
   (B)   After the Commission has prepared and adopted a comprehensive plan, the Commission shall periodically but at least once every 3 years, review the comprehensive plan, any ordinances and any capital improvement program the Council has adopted to implement the plan.
   (C)   After the review it shall, to the extent it deems necessary, revise the comprehensive plan, adopt the amendments or the new comprehensive plan, and recommend it to the Council in accordance with law.
   (D)   Similarly, after the review, it shall recommend to the Council any amendments it deems desirable to the capital improvement program and any ordinance implementing the plan.
   (E)   Request for variances from the literal provisions of this section in instances where their strict enforcement would cause undue hardship because of circumstances unique to the individual property under consideration.
   (F)   In granting a variance, this Board may impose conditions to ensure compliance and to protect adjacent properties. The Board may not permit as a variance any use that is not permitted under this chapter for the property in the zone where the affected person’s land is located.
