(A) General requirement.
(1) Every householder, occupant or owner of any residence shall use the container provided by the licensed collector.
(2) Any restaurant, industrial establishment or commercial establishment shall provide on the premises 1 or more containers to receive and contain all refuse which may accumulate between collections.
(3) All normal accumulations of refuse shall be deposited in those containers.
(B) Container requirements.
(1) Each container shall be water-tight, shall be impervious to insects and rodents, except that any commercial or business establishment having refuse volume exceeding 2 cubic yards per week shall provide bulk or box-type refuse storage containers of a type approved by the Clerk/Treasurer.
(2) Containers shall be maintained in good and sanitary condition.
(3) Any container not conforming to the requirements of this chapter or having ragged or sharp edges or any other defect likely to hamper or injure the person collecting the contents shall be promptly replaced after notice by the city.
(C) Placement.
(1) Where no alley exists, the container shall be placed on the curb withing 3 feet of the street.
(2) Where no street exists and an alley is open to traffic, each container for premises abutting the alley shall be placed at the rear of the property within 3 feet of the alley.
(D) Use of containers.
(1) Refuse shall be drained of liquid and household garbage shall be wrapped before being deposited in a container.
(2) Brush or tree limbs shall not exceed 1/2 inches in diameter or 3 feet in length, and shall be bagged in plastic or biodegradable bags.
(3) The licensed collector shall not be required to collect more than 60 gallons of refuse per week from each residential user.
(E) Unacceptable refuse. The following types of refuse shall not be placed in containers but shall be the separate responsibility of the owner or occupant of the premises to promptly dispose of either through the licensed collector or the nearest hazardous waste disposal site:
(1) Hazardous waste as defined by federal and state laws and regulations;
(2) Explosive waste;
(3) Liquid waste of any type in large quantities;
(4) Radioactive waste;
(5) Steel banding;
(6) Animal remains in large quantities;
(7) Paint, solvents, gasoline and inflammable liquids;
(8) Propane tanks;
(9) Aerosol cans, unless generated through normal household use;
(10) Waste which is infectious, hazardous, inflammable or toxic; human remains;
(11) Tires in large quantities (in single loads);
(12) Large car parts, including gasoline tanks, hardened steel, shafts, engine blocks and steel wheels;
(13) Large metal items;
(14) Steel fence materials;
(15) Large wood items;
(16) Demolition or building waste, including linoleum, carpet and other flooring materials;
(17) Pesticides, insecticides, chemicals or other toxic materials (when not normally in residential or commercial waste);
(18) Soil and sod, rocks, brick, cement and the like;
(19) Brush, trees or limbs exceeding 2 inches in diameter or 3 feet in length; and
(20) Fish and wild game cleanings, unless frozen grass or leaves.
(F) Recycling encouraged. The City of Osakis encourages and supports the concept of recycling in order to keep the costs of garbage down and deal appropriately with environmental concerns.
(G) Recycling requirements.
(1) The city shall be authorized to pass whatever resolutions are necessary to encourage and complete recycling through the garbage service provided to the City of Osakis in connection with state and county requirements together with individual city requirements.
(2) The Council is free from time to time to pass resolutions controlling and regulating recycling.
(H) Recycling provision. The following recycling provisions shall apply in the City of Osakis.
(1) Sixty-four-gallon no sort recycling container will be provided by the refuse hauler. Items that can be put in recycling container are newspaper, magazines, direct mail, glass bottles/jars, aluminum and metal cans, cardboard, chip board, plastic bottles, jugs, jars.
(2) Sixty-four-gallon recycling container shall be picked up every other week by the refuse hauler.
(I) Violation. Anyone bringing garbage refuse or recyclables into the city from outside of the city limits shall be in violation of this chapter.
