1040.02   WATER AND SEWER TAP–IN DEPOSIT FEE FOR LAND RESTORATION.
   In the case of a water, sanity sewer or storm sewer line tap, there is hereby established a deposit in the amount of five hundred dollars ($500.00) to secure restoration of the lands disturbed by the construction of the tap.  The deposit shall be paid to the Village at the time the tap is applied for and the tap fee is paid.  If construction of the tap is completed and the lands restored within thirty days of the start of construction, then the Village shall return the deposit.  However, if restoration is not completed within thirty days of the start of construction, then the Village may retain the deposit and apply it to the cost of restoration by the Village.  Any deposit not used by the Village for restoration shall be returned.  The Water and Sewer Superintendent shall be the inspector of the restoration and the sole determiner of the adequacy of such restoration.  (Ord. 94–11–1.  Passed 11–15–94.)
