(a) There is hereby established a deposit fee in the amount of five hundred dollars ($500.00), cash, to secure restoration of the lands disturbed by construction in the roads rights-of-way within the Village. The deposit shall be paid to the Village Clerk at the time that a permit application is submitted to perform such construction. No construction permit shall be issued without the applicant first tendering the deposit sum in cash. If the construction is completed and the lands restored to their original condition prior to the commencement of construction, within 60 days from the issuance of the permit, weather permitting, then the Village shall return the deposit to the applicant. The Village shall determine whether or not the applicant has fully restored the lands to an appropriate pre-construction condition. If the restoration is not completed within 60 days from the issuance of the permit, weather permitting, or if the lands are not restored to the satisfaction of the Village, then the Village shall retain the deposit sum to apply toward the cost of restoration of the lands to their original condition. The Village may reimburse itself, or an independent contractor, for the time and materials to restore the lands. Any portion of the deposit sum not necessary to restore the lands to their original condition, shall be returned to the applicant.
(b) The Village designates the Street Superintendent to be the individual responsible for determining the propriety of the restoration of the lands referenced herein.
