5-2-5: DEPOSIT IN RECEPTACLES:
   A.   Unlawful: It is unlawful for any person to store, transport, haul, or dispose of garbage except as authorized in this chapter. Occasional hauling by single-family residential customers of garbage to an approved solid waste disposal site is allowed. Such customers shall still be required to pay the applicable charge for garbage collection services. This section shall not apply to the hauling by customers of recyclable material or yard debris to an approved recycling or yard debris disposal site.
   B.   City Or Contract Carrier Supplied Containers: All customers may be required by the city to use containers owned by the city or its contract carrier. No privately owned containers shall be utilized after delivery to a customer of the city owned or contract carrier owned containers.
   C.   Receptacles Required: It shall be the duty of every person occupying, in control of, or responsible for any occupied, single-family residence, multi-family residence, or commercial premises located in the city, where garbage is created or accumulates, to cause the same to be kept in approved containers.
   D.   Containers At Curbside: Except as may be otherwise directed by the contract carrier, containers shall be placed at curbside on a public street or private road on the scheduled collection day, and shall be removed to their proper storage location as soon as possible after collection.
   E.   Recyclables; Yard Debris: Recyclables may be accumulated, for collection by the contract carrier, in recycling carts or recycling containers, or in such other collection containers approved by the city's contract carrier. Yard debris may initially be accumulated for collection by the contract carrier in a yard debris cart and, once such cart is full, in such other collection container approved by the city's contract carrier for overflow volumes.
   F.   Duty Of Owner; Multi-Family: It is the duty of the owner of any occupied multi-family residence to furnish or to see that his/her tenants have adequate solid waste collection service and are adequately supplied with contract carrier provided or approved customer provided drop box containers or other contract carrier approved collection containers.
   G.   Duty Of Owner; Commercial Premises: It is the duty of the property owner of a commercial premises to see that his/her tenants have adequate solid waste collection service and are adequately supplied with a contract carrier provided or approved customer provided detachable container or drop box container or other contract carrier approved collection container.
   H.   Overloading: Containers shall not be overloaded beyond the point where covers can be securely replaced.
   I.   Bulky Goods: Bulky goods shall not be placed in containers.
   J.   Maintenance Of Containers: Contract carrier provided containers for the collection of solid waste, recyclables, and yard debris shall remain on the property of the contract carrier, unless otherwise provided for under the service agreement, and shall be provided for the health, safety, convenience and general welfare of the customer. The containers shall not be damaged, destroyed, or removed from the customer's premises by any person.
   K.   Public Nuisance: Every customer shall have the duty to ensure that solid waste does not accumulate on or around his or her premises in a manner that causes such solid waste to become a public nuisance both as to the amount of such solid waste or the odor emanating from such solid waste. Each container used for the accumulation of solid waste shall be kept clean inside and out, and the area around the containers shall be kept in a neat and sanitary condition. The contract carrier shall provide written notification to the city administrator and the customer concerning any violations of this provision.
   L.   Use Of Another Person's Container: It shall be unlawful to dispose of garbage by placing such garbage into a container which another person owns or pays for the use of without that person's express consent. (Ord. 915B, 11-30-2011)
