5-2-2: DEFINITIONS:
Words used in the present tense in this chapter include the future tense, in the singular include the plural, in the plural include the singular, and in the masculine include the feminine gender. The following words, terms, and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
ASHES: The solid waste products of coal, wood, and other fuels used for heating and cooling all public and private establishments and all residences.
BIOMEDICAL WASTE: Shall have the same meaning as that term is defined at Revised Code Of Washington 70.95K.010 as now or hereafter amended.
BULKY GOODS: Discarded large items of solid waste such as appliances, furniture, small auto parts, and other similar waste materials with weights and volumes greater than those allowed in waste collection bins, carts, or other containers.
CITY: The city of Orting.
COMMERCIAL PREMISES OR COMMERCIAL: Any premises or portion thereof that is not residential in use and character, including retail, service, office, industrial, agricultural, manufacturing, governmental agencies and all other users of commercial type garbage collection services.
CONTAINER: A customer provided garbage can or a contract carrier provided detachable container, drop box container, recyclable cart, recyclable container, or yard debris container, or other contract carrier or city approved cart or container for the storage and disposal of garbage, recyclable material, or yard debris.
CONTRACT CARRIER: The solid waste collection company who, under contract with the city, collects and transports solid waste for disposal by motor vehicle for compensation within the jurisdictional limits of the city.
CURB OR CURBSIDE: On the single-family residence property, within five feet (5') of the public street without blocking sidewalks, driveways, or on street parking. If extraordinary circumstances preclude such a location, curbside shall be considered a placement suitable to the resident, convenient to the contract carrier's equipment, and mutually agreed to by the city and contract carrier.
CUSTOMER: A person who occupies, has control of, is responsible for, or owns an occupied single-family residence or an occupied multi-family residence, or commercial premises or unit thereof.
DETACHABLE CONTAINER: A watertight metal or plastic container equipped with a tightfitting cover, capable of being mechanically unloaded into a collection vehicle, and that is not less than one cubic yard nor greater than eight (8) cubic yards in capacity.
DISPOSAL SITE: The location where any final treatment, utilization, processing, or deposit of solid waste occurs.
DROP BOX CONTAINER: An all metal container with ten (10) cubic yards or more of capacity that is loaded onto a specialized collection vehicle, transported to a disposal or recycling site, emptied and transported back to the customer's site.
FIRE CHIEF: The person appointed or acting as the fire chief for the fire protection district or authority serving the city, or his or her designee.
FOOD WASTE: Vegetable and other food scraps, including meat, dairy products, grease and bones; paper which has been contaminated with food, fat, or grease; and compostable paper including paper towels, paper plates, tissue, and waxed paper, but shall exclude any items which cannot be accepted for processing by the third party compost processing facility.
GARBAGE: All putrescible and nonputrescible solid and semisolid wastes, including, but not limited to, rubbish, ashes, swill, and discarded commodities that are placed by customers in appropriate bins, bags, cans, or other receptacles for collection. The term "garbage" shall not include special wastes, construction/demolition materials segregated from other wastes, or source separated recyclables and yard debris. When the phrase "refuse" is used as a qualifying phrase or otherwise, it means "garbage".
GARBAGE CAN: A container that is a watertight galvanized sheet metal or plastic container not exceeding four (4) cubic feet or thirty two (32) gallons in capacity; fitted with two (2) sturdy handles, on each side; and fitted with a tight cover equipped with a handle. All containers shall be rodent, bird, and insect resistant and kept in a sanitary condition at all times.
HAZARDOUS WASTE: Any substance that is:
   A.   Defined as hazardous by 40 CFR part 261 and regulated as hazardous waste by the United States environmental protection agency under subtitle C of the resource conservation and recovery act (RCRA) of 1976, 42 USC 6901 et seq., as amended by the hazardous and solid waste amendments (HSWA) of 1984; the toxic substances control act, 15 USC 2601 et seq.; or any other federal statute or regulation governing the treatment, storage, handling or disposal of waste imposing special handling or disposal requirements similar to those required by subtitle C of RCRA; or
   B.   Defined as dangerous or extremely hazardous by chapter 173-303 Washington administrative code and regulated as dangerous waste or extremely hazardous waste by the Washington state department of ecology under the state hazardous waste management act, chapter 70.105 Revised Code Of Washington, or any other Washington state statute or regulation governing the treatment, storage, handling or disposal of wastes and imposing special handling requirements similar to those required by chapter 70.105 Revised Code Of Washington; or
   C.   Any substance that after the effective date of the contract with the contract carrier comes within the scope of this definition as determined by the city. Likewise, any substance that after the effective date of the contract with the contract carrier ceases to fall within this definition as determined by the city shall not be deemed to be hazardous waste.
HEALTH OFFICER: The county health officer, or authorized representative.
LANDFILL: A disposal facility or part of a facility at which solid waste is placed in or on land and which is not a land treatment facility.
MINIMUM SERVICE LEVEL: An occupied single-family residential, multi-family residential, or commercial premises garbage collection service at service levels in accordance with the franchise agreement or contract with the contract carrier.
MULTI-FAMILY RESIDENCE OR MULTI-FAMILY: A multiple-unit residence with three (3) or more units in a complex served by a common garbage storage container. Mobile home parks with common garbage storage containers are considered multi-family residences.
OCCUPIED: All single-family residences, each separate dwelling unit of a multi-family residence, and each separate commercial premises unit having active city utility accounts.
PERSON: An individual, firm, association, partnership, copartnership, limited liability company, political subdivision, government agency, municipality, industry, public or private corporation, or any other entity whatsoever.
PRIVATE CARRIER: A person who, in his or her own vehicle, transports solid waste purely as an incidental adjunct to some other established private business owned or operated by that person in good faith. A person who transports solid waste from residential sources in a vehicle designed or used primarily for the transport of solid waste is not a private carrier.
PUTRESCIBLE WASTE: Solid waste which contains material capable of being readily decomposed by microorganisms.
RECYCLABLE MATERIALS OR RECYCLABLES: Those solid wastes that are source separated for recycling or reuse, such as papers, metals, and glass, and that are identified as recyclable material pursuant to the Pierce County comprehensive solid waste plan.
RECYCLING CART: A contract carrier provided wheeled cart suitable for collection, storage, and curbside placement of recyclable material at multi-family residences and commercial customer locations.
RECYCLING CONTAINER(S): A contract carrier provided container suitable for on site collection, storage, and placement of recyclable material at multi-family residence and commercial customer locations.
RESIDENCE AND RESIDENTIAL: Living space(s) individually rented, leased, or owned.
SEWAGE SLUDGE: A semisolid substance consisting of settled sewage solids combined with varying amounts of water and dissolved materials, generated from a wastewater treatment system, that does not meet the requirements of chapter 70.95J Revised Code Of Washington.
SINGLE-FAMILY RESIDENCE: A one-unit house, one unit of a duplex, one unit of a multi-family residence, or a single mobile home, each of which is billed for individual garbage collection located on a public street or private road.
SOLID WASTE COLLECTION: Shall have its usual and ordinary meaning, but does not include collecting or transporting recyclable materials from a drop box or recycling buy back center, or collecting or transporting recyclable materials by or on behalf of a commercial or industrial generator of recyclable materials to a recycler for use or reclamation.
SOLID WASTE OR WASTES: Garbage, recyclables, and yard debris.
SOURCE SEPARATED: The separation of different kinds of solid waste at the place where the waste originates.
SWILL: Shall mean and includes every refuse accumulation of food waste, liquid or otherwise, that attends the preparation, use, cooking, dealing in or storing of meat, fish, fowl, fruit and vegetables except coffee grounds.
YARD DEBRIS: Plant material commonly created in the course of maintaining yards and gardens, and through horticulture, gardening, landscaping, or similar activities, and food waste. Yard debris includes, but is not limited to, grass clippings, leaves, branches, brush, weeds, flowers, roots, windfall fruit, vegetable garden debris, holiday trees, and tree prunings no greater than three feet (3') long and/or four inches (4") in diameter. Yard debris does not include sod, dirt, rocks, bricks, and limbs or tree trunks greater than three feet (3') long and/or four inches (4") in diameter.
YARD DEBRIS CART: A contract carrier provided wheeled cart provided to subscribing single-family residences, multi-family residences, and commercial customers for the purpose of containing and collecting yard debris. (Ord. 915B, 11-30-2011)
