931.01 DEFINITIONS.
   As used in this chapter, certain terms are defined as follows:
   (a)   "City" means the area within the corporate boundaries of the City of Orrville and areas designated by the City.
   (b)   "Commercial bag" means a plastic bag or paper bag expressly manufactured for the purpose of containing refuse and shall not be larger than thirty gallon capacity and shall have a thickness of not less than 1 mil. Each bag shall be securely tied or sealed when full.
   (c)   "Commercial establishments" mean and include all other premises and institutions, public or private, charitable or noncharitable, upon which garbage or rubbish, or both, are created.
   (d)   "Contractor" means the duly authorized agents and/or employees connected with the collection and disposal of refuse under contract with the City to collect and dispose of refuse.
   (e)   "Curbside containers" shall be of a uniform type which are suitable for containing household recyclable materials and are acceptable to the Director. Larger curbside containers for multiple family dwellings or for City buildings and/or parks may be acceptable.
   (f)   "Director" means the Director of Public Safety and Service of the City of Orrville.
   (g)   "Garbage" means all refuse and animal and vegetable matter which has been used for food for man, and all refuse and animal and vegetable matter which was intended to be used, including condemned foods. This meaning shall include excess fruit from trees unless such items are collected as yard waste.
   (h)   "Garbage collector" means the City of Orrville, and each and all of its duly authorized agents and/or employees connected with the collection and disposal of refuse, or those contractors of the City under contract with the City to collect and dispose of refuse.
   (i)   "Household rubbish" includes the picking up from the curbline of residential property only solid or semisolid wastes composed of household goods, household refuse, furniture, springs, mattresses, appliances, tin cans, bottles, crockery, broken glass, rags, grass clippings and other similar debris, hedge cuttings and shrubbery trimmings bundled or boxed, paper, newspapers, magazines tied in bundles, boxed or otherwise contained, furnace pipe, stoves, refrigerators, dishwashers, washers, dryers, water boilers, trunks, tires, incinerator refuse and ashes, wood not over thirty-six inches in length, all rubbish, trash, debris, waste, litter, scrap, packings, carpeting, leather, rubber, excelsior, straw, metal cooking utensils, toys, porcelain, shoes, clothing, cardboard, household appliances, tree trimmings, trees and tree limbs under thirty-six inches in length, and excess fruit from trees on residential property.
Excluded will be recyclable materials and yard waste if collected separately, dirt, stones, broken concrete and other refuse from repairs, alterations, and new construction of buildings and sidewalks, tree limbs and trunks over thirty-six inches in length, whole holiday trees, nontoxic flyash, nontoxic foundry sand, slag, infectious waste, household hazardous waste, and other substances which are harmful or inimical to public health. In addition, the contractor shall not be expected to collect material that would make any one collection exceed 300 pounds.
   (j)   "Householder" means the head of a family or one maintaining his or her separate living room or quarters on premises and includes owners, tenants and occupants of all premises, upon which garbage and rubbish, or both, are created.
   (k)   "Premises" means land or buildings or both, or parts of either or both, occupied by one householder or commercial establishment.
   (l)   "Recyclable material(s)" shall include those commodities which are collected at the curbside or are separated at an intermediate station by the contractor including metals, plastics, glass, and paper products such as newsprint and cardboard and any other commodity identified by the Director.
   (m)   "Refuse" shall include garbage, rubbish, household rubbish, recyclables and yard waste.
   (n)   "Rubbish" means all rags, broken glass, crockery, bottles, tin cans, grass cuttings, hedge cuttings, and household refuse, generally including incinerator ashes and refuse from paper burners. Excluded shall be recyclable materials and yard waste if collected separately.
   (o)   "Yard waste(s)" shall include grass clippings, hedge cuttings, and shrubbery trimmings, tree and tree limbs less than thirty-six inches in length, plant waste which includes excess fruit from trees on residential or public property.

   (p)   Senior citizens shall mean a householder who is sixty-five years of age or older who establishes proof of age to the satisfaction of the Director.
