723.02 REGULATIONS.
   Garage sales shall be regulated in the following manner:
   (a)   Definition. “Garage sales” means any public sale of personal property in any area of the City, and includes such other sales that are commonly referred to as porch, lawn, yard, basement or attic sales.
   (b)   Hours. Garage sales shall not commence before 9 a.m. and must terminate by sundown. No garage sales shall be permitted on Sunday.
   (c)   Frequency. No person shall conduct more than two garage sales on his premise or any other premises in any one calendar year, nor shall any sale exceed a two- day period. “Person” includes all residents living or residing upon the premises where such sale will be conducted.
   (d)   Merchandise. Garage sales shall offer only used, unwanted items of personal property. No new merchandise shall be offered for sale.
   (e)   Signs. Garage sales may be advertised through the newspaper or other news media. A sign, no greater in size than three feet by three feet, may be installed on other property within the same block with the property owner’s consent. No sign shall be placed on the public right-of- way or on property other than where the sale is being conducted except as set forth above. No lighted sign shall be used. The sign shall be displayed only during the sale and shall be promptly removed after the sale.
   (f)   Zoning. It is not the intention of this chapter to change or amend the Zoning Ordinance of the City.
   (g)   License.
      (1)   No person shall conduct any sale commonly known as a garage sale without first having received a license.
      (2)   Upon application by the person desiring such sale, the Director of Public Safety and Service is authorized to issue such a license.
      (3)   The license shall set forth the name and address of each person with merchandise in the sale, and the place and date of sale.
      (4)   There shall be no fee for such license.
