11-1-2: DEFINITIONS:
When used in this chapter, the following terms shall have the meanings indicated:
ALLEY: A passageway open to public travel which affords generally a secondary means of vehicular access to abutting lots and is not intended for general traffic circulation.
COLLECTOR STREET: A street which carries traffic from minor streets to arterial streets, including the principal entrance streets of a residential development and streets for circulations within such a development.
CUL-DE-SACS: Designed to be so permanently, shall not be longer than four hundred feet (400') and shall be provided at the closed end with a turnaround having an outside roadway diameter of at least eighty feet (80'), and a street property line diameter of at least one hundred feet (100').
DEAD END STREET: A minor street with only one outlet and is of a temporary nature, with a turnaround at the end of it. Provision shall be made for further extension of the street into adjoining properties.
FINAL PLAT: The final map, drawing or chart on which the subdivider's plan of subdivision is presented to the council for final approval.
LOT: A parcel or portion of land in a subdivision or plat of land, separated from other parcels or portions by description as on a subdivision or record of survey map or by metes and bounds, for the purpose of sale or lease to, or separate use of, another.
MARGINAL ACCESS STREET: A minor street which is parallel and adjacent to arterial streets and which provides access to abutting properties and protection from through traffic.
MINOR STREET: A street used primarily for access to the abutting properties.
OWNER: Any individual, firm, association, syndicate, copartnership, corporation, trust, or any other legal entity having sufficient proprietary interest in the land sought to be subdivided to commence and maintain proceedings to subdivide the same under this chapter.
PRELIMINARY PLAT: The preliminary map, drawing or chart indicated for the proposed layout of the subdivision to be submitted to the planning and zoning commission for its consideration and recommendations.
SIMPLE LOT SPLIT: The division of a parcel or tract of land within the city or area of impact into no more than three (3) lots or parcels for the purpose of transfer of ownership or building development where new street access is not being created or major extension of public improvements is not required. Lots that are split or divided with the intention of development must meet the minimum zoning and building requirements.
STREET: A way for vehicular traffic, whether designated as a street, highway, thoroughfare, parkway, throughway, road, avenue, boulevard, lane, place, or however otherwise designated.
SUBDIVIDER: Any individual, firm, association, syndicate, corporation, trust or any other legal entity commencing proceedings under this chapter to effect a subdivision of land hereunder for himself or for another.
SUBDIVISION: The division of a parcel or tract of land within the city or area of city impact into two (2) or more lots, tracks, or parcels of land for the purpose of transfer of ownership or building development where new street access is created or major extension of public improvements is required; except that:
   A.   The sale or exchange of parcels of land to or between adjoining property owners where such sale or exchange does not create additional lots shall not be deemed subdivision.
   B.   The allocation of property by court decree in settling the estate of a decedent or in partitioning land among owners shall not be deemed subdivision.
   C.   The unwilling sale of land as a result of legal condemnation procedures, or the acquisition of street rights of way by a public agency in conformance with the comprehensive plan, shall not be deemed subdivision.
   D.   A division of land for agricultural purposes into lots or parcels of five (5) acres or more shall not be deemed subdivision.
   E.   A division of land that meets the definition of a simple lot split.
WIDTH OF STREET: The shortest distance between the lines delineating the right of way of a street. (Ord. 786, 3-8-2016)
