8-2-34: DELINQUENT ACCOUNTS; DISCONTINUANCE AND RESTORATION FEE:
When bills are not paid within thirty (30) days from the past due date, the superintendent shall issue an order to shut off and discontinue water service to such delinquent customers. In case service is discontinued for delinquency, it shall not be restored until the delinquency is paid, or until arrangements for payment satisfactory to the city clerk have been made, together with a fee of ten dollars ($10.00) for discontinuing and restoring service. The fee of ten dollars ($10.00) shall be payable whenever a service trip is made for the purpose of discontinuing service because of nonpayment, even though an actual shutoff may not actually have occurred. In the event that a delinquent customer fails to pay his or her bill within the time set forth above, the city may discontinue city water service or remove or close sewer connections, and enter upon the property for accomplishing such purposes. The expense of digging up and plugging the sewer service line, as well as the expense of restoring said sewer service line back to an operable condition is a debt due to the city and may be recovered by legal action against the sewer user, in addition to the ten dollar ($10.00) fee set forth above.
