6-1-30: POSSESSION OF AN OPEN CONTAINER OF ALCOHOLIC BEVERAGES IN PUBLIC PLACES:
It shall be unlawful for any person to consume any alcoholic beverage or to have in his or her possession any open container of any alcoholic beverage in a public place within the city of Orofino, including, but not limited to, any street, sidewalk, alleyway, park or other public place, or upon private property open to the public without permission of property owner. The exceptions to this law shall be the Orofino City Park, Champion Park, Lewis Clark Park, Memorial Park. Any business holding a valid Revocable encroachment permit issued by the city, and a valid license to sell alcoholic beverages as required by State of Idaho, and Orofino City Code 5-6-2, may allow the possession of open containers of alcoholic beverages on its business premises including such public space or property set forth in that revocable encroachment permit.
