6-1-23: PUBLIC INTOXICATION:
Any person who is upon any public thoroughfare or other public place within the city of Orofino, including any street, sidewalk, public or private parking lot, or any public or private property open to the public and who is intoxicated or under the influence of intoxicating liquor at a level that presents a danger to himself, herself, or others, or creates a disturbance of the peace shall be guilty of a misdemeanor. In addition to any penalties imposed by law, upon conviction, such person shall be assessed restitution for all costs or expenses incurred by any public entity resulting from said person's intoxication, including all costs or expenses relating to obtaining medical screening, medical review, medical clearance or treatment. Said restitution order shall be entered in favor of the public entity incurring such costs or expenses and shall be payable to the general fund of such entity. (Ord. 745, 7-12-2011)
