5-11-3: DEFINITIONS:
For the purposes of this chapter, the following words shall have the meanings indicated unless the context clearly requires otherwise. All other definitions identified in Idaho Code 39-1102 shall apply.
BOARD: The Idaho state board of health and welfare.
CHILD: A person less than thirteen (13) years of age.
DAYCARE: The care and supervision provided for compensation or as voluntary work during part of a twenty four (24) hour day, for a child or children regardless of relationship to the person or persons providing the care.
DAYCARE CENTER: A place or facility providing daycare where thirteen (13) or more children, regardless of relationship to the person or persons providing the care, are in attendance.
DAYCARE PROVIDER: Includes any volunteer, individual, group of individuals, association, partnership, limited liability company or corporation.
DEPARTMENT: The Idaho department of health and welfare.
EMPLOYEE: Any person working for compensation or volunteering in a facility that provides daycare.
FAMILY DAYCARE HOME: A home, place, or facility providing daycare where four (4) or fewer children, excluding children of a family within the second degree of relationship regardless of relationship to the person or persons providing the care, are regularly on the premises.
FOSTER CARE: Childcare by a person not related to the child, in lieu of parental care, in a foster home.
FOSTER HOME: The private home of an individual or family licensed or approved as meeting the standards for foster care and providing twenty four (24) hour substitute parental care to six (6) or fewer children.
FOSTER PARENT: A person or persons residing in a private home under their direct control to whom a foster care license or certification has been issued.
GROUP CARE: Foster care of a number of children for whom childcare in a family setting is not available or appropriate, in a dormitory or cottage type setting, characterized by activities and discipline of a more regimented and less formal nature than found in a family setting.
GROUP DAYCARE FACILITY: A home, place, or facility providing daycare where seven (7) to twelve (12) children, regardless of relationship to the person or persons providing the care, are regularly on the premises.
JUVENILE DETENTION: Defined in section 20-502(6), Idaho Code, of the juvenile correction act.
JUVENILE DETENTION CENTER: A facility established pursuant to sections 20-517 and 20-518, Idaho Code.
NONBUSINESS ACTIVITY: A "family daycare home" which cares for six (6) or less children regularly on the premises regardless of relationship to the person or persons providing the care.
SECOND DEGREE OF RELATIONSHIP: Persons related consanguineously ("blood relative") and affinially ("relative by marriage") and includes their spouses. The number of degrees between two (2) relatives is calculated by summing the number of ties between each relative and the common ancestor. (Ord. 767, 9-28-2010)
