1. It shall be unlawful to own or house hens without a valid coop permit. A coop for the keeping of hens as an accessory use in any Residential Zoning District may be permitted in accordance with the following:
a. Permitted only on residential properties with a minimum lot area of one (1) acre.
b. All hens shall at all times be provided a shelter and an adjacent fenced area.
i. The outside fenced area shall be no less than eighty (80) square feet in area and shall be demarcated with a fence constructed of wood or metal, excluding barbed wire or razor wire, and not greater than four (4) feet in height.
ii. The shelter shall be a maximum fifty (50) square feet in area and maximum six (6) feet in height.
Animals
iii. The shelter shall contain a permanent electric heat source. Extension cords are not permitted.
iv. Hens shall only be kept in a coop shelter.
b. The shelter and adjacent fenced area shall be located in the rear yard between the principal structure and the rear lot line, and a minimum:
i. Ten (10) feet from the residence of the owner of such animals.
ii. One hundred (100) feet from any neighboring residence.
iii. Thirty (30) feet from the rear and side lot lines.
iv. One hundred (100) feet from the lot line of any school, church, or public street.
c. All animal waste and byproduct shall be routinely and properly disposed.
d. Hens shall be kept for personal, non-commercial use only. No person shall engage in breeding, fertilizer production, or the production of eggs for commercial purposes.
e. A building permit must be issued by the Development Services Department prior to the installation or construction of any structure and fenced area for the keeping of hens.
i. By submitting a coop permit application, the applicant grants permissions for any Village Building or Code Enforcement official to access the property to ensure compliance with relevant code regarding hen keeping.
ii. Coop permits are valid for five (5) years from the date of issuance. Applicants must obtain a new permit before the expiration date to continue hen keeping.
2. A maximum eight (8) hens are permitted per lot. Roosters are prohibited.
3. Slaughter of hens within the Village is prohibited.
