A person may seek conditional approval for a Class A, A-5, B, C, D, E, H, I, J, M or N license, at a premises to be constructed, reconstructed or substantially rehabilitated. The application for conditional approval shall be submitted to the Development Department in accordance with rules promulgated by the Local Liquor Control Commissioner. The applicant shall also pay all required application fees for the subject license. Upon receipt of the application for conditional approval and the fee, the Development Department shall forward the information to the appropriate departments for review. Upon completion of the review, the Local Liquor Control Commissioner shall notify the applicant whether the applicant is conditionally approved to receive the described license for the subject premises, conditioned upon: (i) the applicant completing the structure substantially as presented in the building plans and floor plan submitted with the application for conditional approvals; (ii) rough and final inspection approval; (iii) issuance of a proper business license; and (iv) any other items deemed necessary by development services and the Local Liquor Control Commissioner. The conditional approval shall be valid for one (1) year from the date of issuance. The fee for a conditional approval is two hundred fifty dollars ($250.00).
