(A) The Town Clerk-Treasurer is designated as the ADA Coordinator for the town, who shall be responsible for overseeing compliance with the nondiscrimination laws as they relate to persons with a disability.
(B) The notice under the Americans with Disabilities Act, being 42 U.S.C. §§ 12101 et seq. A copy of which is attached hereto, is adopted by the town as the notice under the Americans with Disabilities Act. Said notice shall be made available in alternative formats when necessary and posted in town facilities, in job postings and meeting notices as deemed appropriate.
(C) The Town ADA Grievance Procedure under the ADA, a copy of which is attached hereto, is adopted as the grievance procedure for addressing complaints alleging discrimination on the basis of disability in the provision of services, activities, programs or benefits by the town. Said grievance procedure shall be made available in alternative formats when necessary and shall be posted in town facilities as deemed appropriate.
(D) The town hereby adopts the most current ADA Standards for Accessible Design, and any subsequent required standards for accessible design. In addition, the town hereby adopts the most current Guidelines for Pedestrian Facilities in the Public Right-of-Way, and any subsequent required guidelines for pedestrian facilities in a public right-of-way.
(E) In compliance with federal and state laws as set forth above, the town resolves to post the required information regarding the ADA Coordinator, Notice and Grievance Procedure under the ADA at such locations as may be determined from time to time.
(F) The express or implied repeal or amendment by this section of any other resolution or part of any other resolution does not affect any rights or liabilities accrued, penalties incurred or procedures begun prior to the effective date of this section. Those rights, liabilities and proceedings are continued, and penalties shall be imposed and enforced under the repealed or amended resolution as if this section had not been adopted.
(G) To the extent required by the ADA, the town shall undertake a self-evaluation and inventory of all of its facilities, programs, policies and activities to evaluate any access barriers to public facilities and develop a transition plan for removing the access barriers identified in said inventory, including a budget and schedule for improvements.
