No person shall burn leaves, refuse, trash or set fire to any material in any public street or alley of the town, or within 40 feet of any building in the town; excepting nothing in this subchapter shall prohibit such burning in any street or alley if such burning is done in an incinerator or container approved by the Fire Department.
