(A) The initiation of the process for having an area declared either an economic revitalization area or a residentially distressed area is commenced by filing a petition requesting such a declaration with the Clerk-Treasurer of the town, which shall contain the following:
(1) A sworn statement stating the factual basis for the determination required by the Town Council for the declaration;
(2) A sworn statement as to the proposed reuse and development of the area, and the factual basis for the declaration being in the public interest of said town, in setting forth the factual basis an averment of increases in employment opportunities, assessed valuation of the town and diversification of employment shall be deemed insufficient to sustain such a determination;
(3) A sworn statement setting forth a factual basis as to fairness of granting said petition as to the existing commercial and industrial taxpayers;
(4) A map, and plats, identifying the area and simplified description of the boundaries of the area; and
(5) A properly executed statement of benefits in the prescribed form.
(B) In addition, the petitioner shall submit a non-refundable fee to the Clerk-Treasurer equal to the estimated cost of publishing the required notices, plus $100, except as to any petition from any petitioner from whom the collection of such fees is prohibited.
