§ 52.32  PRESENT RULES SUPERSEDE ANY PRIOR RULES
   (A)   All rules and regulations heretofore promulgated by the utility governing the services provided and supplied by the utility are superseded and replaced by the foregoing general rules and regulations; provided, however, this code of rules and regulations does not replace or supersede any ordinance of the Town Council, or the terms or provisions of any contract or easement agreement executed in connection with an FmHA financing for said utility.
   (B)   In the event that these rules conflict with the terms and provisions of any such ordinance, contract or easement agreement, then the following rules of construction shall apply:
      (1)   The source which grants the greater authority to the utility shall apply;
      (2)   The source which is the most restrictive insofar as use of the water system by the consumer shall apply;
      (3)   Any terms or provision which shall be required by the terms of any FmHA financing, or by the terms of any rule or regulation of the Environmental Protection Agency, the State Board of Health or the State Department of Natural Resources shall apply; and
      (4)   The source which grants the greater remedies to the utility for the collection of sums owed or for requiring connection to the municipal water system shall apply.
