§ 150.201 TEMPORARY OCCUPANCY PERMIT; ISSUANCE.
   (A)   For the purpose of this section the following definition shall apply unless the context clearly indicates or requires a different meaning.
   TEMPORARY OCCUPANCY PERMIT. A permit which may be issued by the Village Building Commissioner. The permit allows occupancy of a building noting that not all relevant code sections have been met, including grading and landscaping provisions.
   (B)   Duration.
      (1)   A temporary occupancy permit shall be valid for 90 days from date of issuance. The request for a temporary occupancy permit must be accompanied by the appropriate fee and a cash escrow or certificate of deposit to the village in the amount of twice the amount of the Building Commissioner's estimate of the cost necessary to bring all irregularities into compliance with codes and municipal ordinances. In no case shall this escrow or certificate be less than $300. In the event that an escrow amount is required by another agency, evidence of that escrowed amount will be credited toward the minimum escrow amount required by the village.
      (2)   A temporary occupancy permit may be renewed at the developer or owner's request, but only one such renewal will be allowed. The renewal shall also be valid for 90 days, but must be made prior to the expiration of the original permit. If the original permit expires, no renewal shall be granted. The request for renewal must be accompanied by the appropriate fee.
   (C)   Fee. Each temporary occupancy permit or renewal of a temporary occupancy permit shall only be issued upon payment of a non-refundable fee of $50 for processing by the village.
   (D)   Review. The Building Commissioner will review each temporary occupancy permit prior to the expiration date and conduct an inspection if no request for renewal is made. Expiration of the permit, whether original or renewal, without correction of the necessary areas of noncompliance with the appropriate codes and ordinances shall be prima facie evidence of a violation of this section.
