Any debris, garbage, abandoned or discarded property, dirt, fill, building materials, or material of any other nature dumped, deposited, or allowed to remain upon any public or private real estate within the village, except when such is being used for the filling, back filling, leveling, grading, construction upon, or landscaping of that real estate upon which a permanent building has been or is being constructed, or except within an enclosed area designed for such purpose upon real estate which is zoned to permit such a use, is hereby declared to be a nuisance, and the same may be removed, buried, spread, or otherwise abated by the Village President or the Board of Trustees, or such other person as he may from time to time designate.
