§ 91.90 DOG BITES.
   No person shall permit or allow a dog in his or her possession or control to bite a person or another animal. A person shall be held strictly liable for any bite inflicted by a dog in his or her possession or control.
   (A)   First offense. A person shall be fined $100 the first time a dog in his or her possession or control bites a person or another animal. Additionally, that dog shall have to wear a muzzle as required by the village at all times.
   (B)   Second offense. A person shall be fined $250 the second time a dog in his or her possession or control bites a person or another animal. If the dog is not wearing a muzzle as required in division (A) of this section, the fine shall be increased to $500.
   (C)   Third offense. A person shall be fined $500 the third time a dog in his or her possession or control bites a person or another animal. If the dog is not wearing a muzzle as required in division (A) of this section, the fine shall be increased to $1,000. Additionally, that dog will no longer be allowed on any properly owned or controlled by the village.
   (D)   Any person who owns or controls a dog that is required to wear a muzzle, as described in division (A) of this section, but is not wearing the required muzzle, shall be fined $500 per offense. Additionally, any person who owns or controls a dog that is prohibited from being present on property owned or controlled by the village (as described in division (C) of this section), but is present on such property, shall be fined $500 per offense.
   (E)   In the event the Administrative Hearing Officer deems any dog to be dangerous or vicious as defined in the definitions of § 91.80, then the animal must wear a muzzle at all times while outdoors. If such dog is not wearing the muzzle as required by the Administrative Hearing Officer, fines will be set in accordance with divisions (A) through (D) above.
