§ 156.57 FEES AND EXPENSES; COLLECTION PROCEDURE.
   (A)   Any person filing or causing to be filed with the village, a sketch plan or a preliminary plan for approval by the village, shall be responsible for all engineering, legal, planning, administrative, and field inspection expenses incurred by the village in connection with the review and approval and inspection of the sketch plan, preliminary plan, final plan, and all public and private improvements which are required by this subdivision code and it shall be unlawful for any person who is billed for such expenses to fail to remit payment for same to the village within 30 days of the invoice.
   (B)   In addition to all other requirements, at the time a sketch plan or a preliminary plan is filed with the village, the person filing the sketch plan or preliminary plan shall make a partial fee deposit with the village which shall be applied to the fees described in division (A) which shall be based on the below schedule.

The Building Commissioner is authorized to review and adjust the deposit amounts as necessary based upon his or her perception of the magnitude of the project or petition submitted.
   (C)   At such time as the village completes its review of the preliminary plan it will bill the applicant for the estimated cost of the village's engineering, legal, planning, administrative, and field inspection services to be rendered in connection with the preliminary and final plans and the completion of the public and private improvements required under this subdivision code. All such invoices shall be paid within 30 days of the date of the invoice and no further review or investigation of the plan shall be made by the village until such time as the invoice has been paid. All delinquent invoices will be subject to monthly late fees equal to 1.5% of the outstanding balance of the invoice.
   (D)   The estimated cost described in division (C) shall be 5% of the estimated cost of construction of all improvements, private and public which are required under this subdivision code. The estimated cost shall be payable as follows:
      (1)   Two and one-half percent shall be paid upon the village's approval of the estimated cost of the public improvements.
      (2)   Two and one-half percent shall be paid upon the village's approval of the final plan.
      (3)   The village shall be reimbursed for the balance of its expenses as a condition of the acceptance of the public improvements by the village.
