169.03 RESIDENCY.
   (a)    The City Administrator, Director of Public Service, Director of Public Safety, Finance Director, Budget Director, Police Chief, Fire Chief, Director of Parks and Recreation, Commissioner of Building and Zoning, Superintendent of Streets, Assistant Fire Chief, Superintendent of Wastewater Treatment, Superintendent of Water Treatment, Supervisor of Water Distribution and Meters are required to live in the City limits.
   All persons accepting appointment in the above noted positions shall establish residency within the City limits within one year from the date of their appointment and shall maintain their residency within the City thereafter as a condition of their continued employment.
   (b)    Waivers to this residency section will be considered on a case-by-case basis by the Mayor and City Administrator. The decision of the Mayor is final. The procedure for requesting such a waiver is as follows:
       (1)    It must be established that a real hardship will accrue to the individual.
       (2)    It makes more sense for the employee to live outside the City because they will actually have better accessibility to their primary work area than if they lived in the City.
       (3)    All waiver requests must be in writing.
   (c)    All individuals except those mentioned in subsection (a) hereof who are accepting appointment as permanent full-time and part-time employees for positions which are not included as a part of any collective bargaining unit shall establish residency within ten miles of the City within one year from the date of such appointment and shall maintain their residency within such distance thereafter as a condition of their continued employment.
