Section 2. Procedure for Promotion.
   As to the City except as provided in a collective bargaining agreement: Except as provided in Section 3 of this Rule IX whenever there is a vacancy in a position in any department above the lowest grade, the Commission shall ascertain whether there are at least three persons who have served six months or more in a lower grade, eligible and willing to compete to fill the vacancy and in case it is found that there are at least three such persons, a vacancy shall be filled from the eligible list resulting from competitive examination based on a passing grade for such competitive examination plus a review of past work performance for promotion.
   In the event there are less than three such persons, the Commission may:
       (1)    Conduct a competitive promotional examination.
       (2)    Hold an original competitive examination to fill the vacancy.
       (3)    Certify to the appointing authority a name from an existing eligible list for such position.
       (4)    Permit the appointing authority to nominate one of such eligible persons for promotion without competition, but in all cases of promotion without competition, the appointing authority shall submit a written statement showing that the duties performed by the person nominated are a natural preparation for the higher position, and that such person is entitled to promotion by reason of length of experience and effective performance.
