1509.03 AMENDMENTS.
   The Ohio Fire Code (OFC) adopted under Section 1509.01 is modified by the enactment, amendment or deletion of the following provisions:
CHAPTER 1301:7-7-01 PERMITS AND INSPECTION FEE, GENERAL
 
   (L)   Section 112 - Fire Marshal Permits and Inspection Fees is hereby replaced in its entirety with the following:
Permits and inspection fees required. Except for those permits which are expressly issued by the State Fire Marshal, all permits specified in this Code will be issued by the Bureau of Fire Prevention. The Bureau of Fire Prevention shall require reasonable fees for such permits. Permits shall at all times be kept on the premises designated therein and shall at all times be subject to inspection by the Bureau of Fire Prevention. The Bureau of Fire Prevention shall require inspection fees as follows:
      (1)   ANNUAL FIRE PREVENTION INSPECTIONS FEES:
         1.   Paint spray shops: Auto body shops and other commercial enterprises engaged in spray painting operations must pay an annual fire prevention inspection fee of fifty dollars ($50.00).
         2.   Bowling establishments:
            (A)   Engaged in refinishing operations involving the use of flammable liquids must pay an annual fire prevention inspection fee of fifty dollars ($50.00) plus the area fees under item #6 below.
            (B)   Not engaged in pin refinishing operations must pay an annual area fees under Item #6 below.
         3.   Dry cleaning plants must pay an annual fee as follows based on flashpoint of solvents used as follows:
            Type III B w/Flashpoint >299 degrees    $50.00
            Type IIIA w/Flashpoint - 140 to 200 degrees 60.00
            Type II w/Flashpoint < 100 degrees    70.00
         4.   Dust explosion hazards: Grain elevators, flour, starch or feed mills or plants pulverizing aluminum, coal, cocoa, magnesium, spices, sugar or other material producing dust which if mixed with air in the proper proportions becomes explosive, but shall not include the electrical power plants, must pay an annual fire prevention inspection fee of one hundred dollars ($100.00).
         5.   Lumber yards and wood working plants which use or store more than 100,000 board feet of lumber must pay an annual fire prevention inspection fee of one hundred dollars ($100.00).
         6.   Public Assembly: All theaters, dance halls, public rental halls, skating rinks, dining establishments and other places of assembly accommodating more than 100 or more persons must pay an annual fee in accordance with the following schedule:

         7.   Vehicle Filling Stations: Any place, building, pump or device operated and maintained upon any public street, highway or place in the City where gasoline or other motor fuels are kept for sale, at retail, to the public must pay an annual fire prevention inspection fee of fifty dollars ($50.00), plus an additional three dollars ($3.00) for each nozzle; more than four nozzles, located on the premises.
         8.   Storage of Motor Fuels: Any place, building, pump or device operated and maintained on private property where gasoline or other motor fuels are stored and dispensed for private consumption must pay an annual fire prevention inspection fee of fifty dollars ($50.00).
         9.   Marine Service Stations: Same as #7 Vehicle Filling Stations above.
         10.   Vehicle Repair Garages which do not dispense, sell or store gasoline in quantity consumptions must pay an annual fire prevention inspection fee of fifty dollars ($50.00).
         11.   Automobile wrecking yards, junk yards and waste material handling plants consumption must pay an annual fire prevention inspection fee of fifty dollars ($50.00).
         12.   Combustible Gases: Any person, firm or corporation storing, handling or using at normal temperatures and pressures more than 2,000 cubic feet of flammable compressed gas or 6,000 cubic feet of non-flammable compressed gas in conjunction with welding or cutting operations must pay an annual fire prevention inspection fee of one hundred dollars ($100.00).
         13.   Combustible Fibers: Any person, firm or corporation involved in the equipment, process and operation for handling, storage or use of combustible vegetable or animal fibers including, among others, readily ignitable and free burning fibers such as cotton, sisal, henequen, ixtle, jute, hemp, tow, cocoa fiber, oakum, baled waste paper, kapok, hay, stray, Spanish moss, excelsior, certain synthetic fibers and cloth, scraps in quantities in excess of 100 cubic feet must pay an annual fire prevention inspection fee of one hundred dollars ($100.00).
         14.   Wholesale paint stores engaged in handling, dispensing, storage, use or sale of bulk flammable liquids must pay an annual fire prevention inspection fee of seventy dollars ($70.00).
         15.   Retail paint stores engaged in storing, handling, use or sale of bulk flammable liquids must pay an annual fire prevention inspection fee of fifty dollars ($50.00).
         16.   Wholesale Bulk Stations: Any place where flammable liquids are stored in quantities, or from which they are sold at wholesale or delivered into tank trucks or tank cars. Such places shall include marine terminals or plants where flammable liquids are blended, but shall not include oil refineries, paint plants, or places where tanks are installed for use exclusively for the storage of fuel oil for use upon the premises. Wholesale bulk stations must pay an annual fire prevention inspection fee of one hundred dollars ($100.00).
         17.   Paint factories must pay an annual fire prevention inspection fee of one hundred dollars ($100.00).
         18.   Sign shops in silkscreen operations must pay an annual fire prevention inspection fee of fifty dollars ($50.00).
         19.   Chemical manufacturing and storage facilities must pay an annual fire prevention inspection fee of one hundred dollars ($100.00).
         20.   Hazardous Material and Chemicals: Any person, firm or corporation storing, handling more than fifty-five (55) gallons of corrosive liquids, or more than five hundred (500) pounds of oxidizing materials, or more than ten (10) pounds of organic peroxides, or more than five hundred pounds of nitro methane, or one thousand (1,000) pounds or more of ammonium nitrate, ammonium nitrate fertilizers and fertilizer mixtures or any amount of highly toxic material or poisonous gas, or the storing, handling of any installation of more than one micro curie of radium not contained in a sealed source or any amount of radioactive material in a sealed source or sources, or any amount of radioactive material for which a specific license from the United States Atomic Energy Commissioner (AEC) is required in accordance with nationally recognized good practice, must pay an annual fire prevention inspection fee of one hundred dollars ($100.00).
         21.   Liquefied Petroleum Gases: Any person, firm or corporation storing, liquefied petroleum gas (LPG) in containers having a capacity in excess of 299 gallons must pay an annual fire prevention inspection fee of fifty dollars ($50.00), plus two dollars ($2.00) per each 100 gallons of capacity over 2,000 gallons. If the capacity exceeds 5,000 gallons, a flat rate annual fee of one hundred dollars ($100.00) must be paid.
         22.   Magnesium processing: Any person, firm or corporation engaging in melting casting, heat treating, machining or grinding more than ten (10) pounds of magnesium per working day must pay an annual fire prevention inspection fee of one hundred dollars ($100.00).
         23.   Material Storage: Any person storing in any building or upon any premises 2,500 cubic feet (70 m3) gross volume of combustible empty packing cases, barrels or similar containers, or rubber tires, balled cotton, rubber, cork, or other similarly combustible material shall pay an annual fire prevention inspection fee of fifty dollars ($50.00).
         24.   Cellulose Nitrate (Pyroxlyin) Plastics: Any retailers, jobbers and wholesalers storing or handling more than 25 pounds (11.35 kg) of cellulose nitrate (pyroxylin) plastics shall pay an annual fire prevention inspection fee of fifty dollars ($50.00).
         25.   Hazardous Production Materials. Any person, firm or corporation storing, handling or using hazardous production materials shall pay an annual fire prevention inspection fee of fifty dollars ($50.00).
         26.   Cryogenic Liquids: Any person, firm or corporation engaged in the production, storage, or sale of cryogenic liquids shall pay an annual fire prevention inspection fee of fifty dollars ($50.00).
         27.   Organic Coatings: Any person, firm or corporation engaged in a manufacturing operation making more than 1 gallon (0.00379 m3) of an organic coating on any working day shall pay an annual fire prevention inspection fee of fifty dollars ($50.00).
         28.   Heliport, Airports: Any facility operated for the storage, landing and refueling of helicopters and airports shall pay an annual fire prevention inspection fee of fifty dollars ($50.00).
All annual fire prevention permits must be paid annually for each separate location within the City and are due by July 1. Payment shall be made to the Oregon Fire Department. After July 30, permit fees are considered delinquent and subject to a 25 percent penalty.
      (2)   SCHEDULE FOR FIRE PREVENTION PLANS AND SPECIFICATIONS REVIEW AND TEST FEES:
         1.   Automatic Sprinkler Review: The fee for the sprinkler shop drawing review and installation test is based on the number of sprinkler heads in the system.

7.   Fire Alarm System:
   A)   Automatic Fire Alarm & Detection Systems: The fee for an automatic fire alarm & detection system is based on the number of sending, signaling and detecting devices in the system.

The presence of a code official at the acceptance test, where required, is included in the review fee on a first time basis. Should subsequent test become necessary, for whatever reason, for approval of the system or systems, a fee of one hundred dollars ($100.00) shall be paid for the presence of the fire official at each subsequent test.
         8.   Fire Flow Test: All fire flow tests conducted by the Division of Water for the determination and application of required fire flow shall be done at the expense of the permit applicant.

         9.   In addition to the above fees, a charge of $60.00 will be applied for all sprinkler, suppression and fire alarm systems required for review by a master plans examiner in conformance with the Ohio Building Code.
Payment of the above listed fees shall be made to the Building and Zoning Inspection Department and must be paid before plans are approved or tests are conducted.
      (3)   SCHEDULE OF BUREAU OF FIRE PREVENTION PERMIT FEES FOR EXPLOSIVES AND FIREWORKS.
         1.   Blasting: Any person, firm or corporation doing blasting shall, prior to issuance of a permit, file a bond deemed adequate in each case by the Bureau of Fire Prevention, which bond shall be available for payment of any damages arising from the permitted blasting and coincidental with posting of bond, payment for a fire prevention inspection fee of one hundred dollars ($100.00).
         2.   Fireworks: The permittee shall post a bond in an amount deemed adequate by the Chief of the Fire Prevention Bureau for payment of all damages which may be caused either to a person or persons or to property by reason of the permitted display, and arising from any acts of the permittee, his agents, employees or subcontractors. Coincidental with posting bonds, payment of a fire prevention inspection fee of seventy-five dollars ($75.00) is required.
Payment of the above listed fees shall be made to the Bureau of Fire Prevention and must be paid before plans are approved and at the time of application.
      (4)   ADDITIONAL PERMITS:
The Mayor, the Chief of the Fire Division and the Chief of the Fire Prevention Bureau shall act as a committee on determination, and specify any new materials, processes, or occupancies, and trades which constitute a fire hazard which shall require permits, in addition to those now enumerated in this code. The Chief of The Fire Prevention Bureau shall publish annually in a conspicuous place in this office, and shall also maintain in his office details and descriptive drawings showing approved and acceptable methods of storing, handling or protecting such materials as shall be deemed to require a permit.
   (H)   Section 108 Appeal of Orders is hereby replaced in its entirety with the following:
APPEALS: Appeals to the board may be taken by any person aggrieved by any decision or interpretation of the Bureau of Fire Prevention made under the provisions of this code.
The Mayor, upon receipt of such appeal, shall call the meeting of the Board of Appeals on Fire Prevention, which Board shall consist of the Mayor, who shall serve as chairman, Director of Public Service, and Director of Law or their delegates. Within ten days from the receipt of such appeal, investigation into the facts to determine if the notice, order of abatement, decision or refusal to issue a permit by the Chief of the Bureau of Fire Prevention is in accordance with the provisions or intent of this Code and shall reverse or revoke or modify the notice, order of abatement, decision or refusal to issue a permit, the same shall remain in full force and effect.
The Board of Appeals on Fire Prevention shall give notice in writing to the affected parties of this approval, revocation or modification of the notice, order of abatement or refusal to issue a permit, and if its decision constitutes an approval, such notification shall contain a statement as to the time within which the notice or order shall be complied with.
CHAPTER 1301:7-7-05 FIRE SERVICE FEATURES
 
   (H)   Section 508 Fire Protection Water Supplies.
      (a)   508.5.1 Where required is hereby replaced in its entirety with the following:
   Hydrants: If major portion of any building is over 400 feet from City water main and hydrants, the owner shall provide hydrants on his property at locations designated by the Chief of Fire Prevention Bureau. The measurement of distance shall be along the route of inbound travel by the fire apparatus laying the line.
Private hydrants shall be supplied by at least an eight-inch main and hydrants shall conform to the specifications of hydrants used by the Oregon Water Division.
Plans for fire lines (water mains) on private property shall be submitted to the Building and Zoning Inspection Department for approval before installation is started.
