1365.05 CLASSIFICATIONS.
   (a)   Heating, Ventilating and Air Conditioning and Refrigeration.
      (1)   Classes of shop registration.
         A.   Heating, ventilating and air conditioning.
            1.   Heating, ventilating and air conditioning contractor's shop means a certificate which authorizes the holder thereof to engage in the business of heating, ventilating and air conditioning.
            2.   Heating, ventilating and air conditioning service contractor's shop means a certificate authorizing the holder thereof to engage in the business of service and/or repair of heating, ventilating and air conditioning, excluding refrigeration systems.
         B.   Refrigeration.
            1.   Refrigeration contractor's strop means a certificate which authorizes the holder thereof to engage in the business of installation, alteration, replacement or repair of any refrigerating system or any piping, apparatus, appliance, device or accessory connected therewith.
            2.    Restricted refrigeration contractor's shop means a certificate which authorizes the holder thereof to engage in the business of installation, alteration, replacement or repair of portable refrigerating systems.
      (2)    Classes of certificates of qualification. 
         A.    Heating, ventilating and air conditioning.
            1.    Heating, ventilating and air conditioning contractor means any person who proceeds with or has charge of laying out or installation, alteration, replacement or repair of any heating, ventilating and air conditioning system or any appliance, apparatus, device or accessory connected to it including precharge refrigeration system. The contractor shall not install, alter, replace or repair refrigerating systems other than the precharge type.
            2.    Heating, ventilating and air conditioning mechanic means one who has learned the trade of heating, ventilating and air conditioning mechanics and is so qualified as provided for in this chapter to work at such trade under the supervision or direction of a licensed heating, ventilating and air conditioning contractor.
            3.    Heating, ventilating and air conditioning service contractor means any person who proceeds with or has charge of service and/or repair of heating, ventilating and air conditioning systems or any appliance, apparatus, device or accessory connected to it excluding refrigerating systems.
            4.    Heating, ventilating and air conditioning service mechanic means one who has learned the trade of heating, ventilating and air conditioning service mechanics and is so qualified as provided in this chapter to work at such trade under the supervision or direction of a licensed heating, ventilating and air conditioning service contractor.
         B.    Refrigeration.
            1.    Refrigeration contractor means any person who proceeds with or has charge of the laying out or installation, alteration, replacement or repair of any refrigerating system or any piping apparatus, appliance, device or accessory connected therewith. This contractor shall not install, alter, replace or service heating systems.
            2.    Refrigeration mechanic means one who has learned the trade of refrigeration mechanics and is so qualified as provided for in this chapter to work at such trade for or under the direction or supervision of a refrigeration contractor.
            3.    Restricted refrigeration contractor means any person who proceeds with or has charge of installation, alteration, replacement or repair of portable refrigeration systems.
            4.    Restricted refrigeration mechanic means any person who has learned the trade of portable refrigeration mechanic and is so qualified as provided for in this chapter to work at such trade for or under the direction or supervision of a restricted refrigeration contractor.
            5.    Refrigeration operator means any person who qualifies as a refrigeration mechanic who proceeds with the repair and service of any refrigeration system and who is a regular and full-time employee of the owner of such refrigeration system.
   (b)    Electrical.
      (1)    Classes of licenses.
          A.    General electrical contractor means one who possesses, in addition to the purely mechanical trade knowledge and craftsmanship of a journeyman electrician, a knowledge of plan making, plan reading and the ability to lay out in the field electrical installations for all occupancy classifications.
         B.    Journeyman electrician means one who has learned the trade of electrician and is so qualified as provided for in this chapter to work at such trade for or under the supervision of an electrical contractor, either general or residential.
         C.    Residential electrical contractor means one who possesses a knowledge of plan making, plan reading and the ability to lay out in the field electrical installation for one, two and three-family residential occupancies.
         D.    Residential wireman means one who has learned the trade of electrical wireman and is so qualified as provided for in this chapter to work at such trade for or under the direction or supervision of a residential electrician.
         E.    Electrical maintenance contractor means one who has learned the trade of installing, servicing, maintaining, altering and repairing electric devices, appliances and equipment.
          F.    Maintenance electrician means one who has learned the trade of maintenance electrician and is so qualified as provided for in this chapter to work at such trade for or under the direction or supervision of an electrical maintenance contractor.
      (2)    Shops.
         A.    General.
            1.    No person, firm or corporation shall display a sign stating or implying that he, they or it are electrical contractors, or advertise by means of business cards, stationery, advertisement or trade or telephone listing or otherwise indicate or represent, orally or in writing that he, they or it are in the electrical business or trade, unless he, they or it first obtain a certificate of shop registration as provided by this chapter.
            2.    Nothing in this chapter shall prohibit a general contractor not registered as herein provided from bidding upon or soliciting electrical work in connection with the construction, remodeling, alteration or repair of a building or premises, provided all such work is done by or under the supervision or direction of a person registered to do such work as provided by this chapter.
            3.    No person, firm or corporation holding a certificate as provided herein, shall loan or extend the right or privileges given there; under for work contracted for or done by any person other than the registrant or persons working under his direction or supervision and any violation thereof shall cause such certificate to be suspended or revoked as hereinafter provided.
         B.    Revocation of certificates. No certificate issued in accordance with the provisions of this chapter shall be assignable or transferable. Any such certificate may, after hearing, be suspended or revoked by the Commissioner, if the person, firm or corporation holding such certificate willfully, or by reason of incompetence, violates any statutes of the State or any ordinance, rule or regulation of the City relating to work performed under requirements or certification.
         C.    Certificates defined.
            1.    Certificate of qualification means a certificate which authorizes a person, by reason of qualification through an examination, to install and/or supervise work in accordance with the provisions of this chapter.
            2.    Certificate of shop registration means a certificate authorizing a person, firm or corporation through registration and payment of fees, to engage in the business of operating a shop as defined in this chapter.
         D.    Shop defined.
            1.    "Shop" means a place of business established, equipped, maintained and operated by an individual, firm or corporation for the purpose of engaging in and carrying on the work or trade for which they have obtained a certificate of shop registration.
            2.    A shop must have in its employ a person qualified in the trade through an examination, as provided for in this chapter. A holder of a certificate of qualification cannot operate out of more than one shop.
            3.    In the event that the business association with, or employment of the holder of a certificate of qualification by the shop terminates, such shop shall become void ten days after such termination except where another person is designated as the holder of a certificate of qualification and a new certificate of shop registration is obtained.
         E.    Classes of shop registration.
            1.    General electrical contractors shop means a certificate which authorizes the holder thereof to engage in the business of installation, alterations and repair of any electrical wiring device, appliance or equipment in all occupancy classifications.
            2.    Residential electrical contractor's shop means a certificate which authorizes the holder thereof to engage in the business of installation, alteration and repair of any electrical wiring device, appliance or equipment in one, two and three-family residential occupancies only.
            3.    Electrical maintenance contractor's shop means a certificate which authorizes the holder thereof to engage in the business of installation, servicing, maintaining, altering and repairing electric devices, appliances and equipment and the connection thereof to power outlets provided such connections are to existing outlets only.
   (c)    Plumbing and Steam Fitting.
      (1)    Classes of licenses.
         A.    Master steamfitter means one who possesses, in addition to the purely mechanical trade knowledge and craftsmanship of a journeyman, a knowledge of plan making, plan reading and the ability to layout in the field steamfitting installations for all occupancy classifications.
         B.    Journeyman steamfitter means one who has learned the trade of a steamfitter and is qualified as provided in this chapter to work at such trade for or under the supervision of a master steam fitter.
         C.    Master plumber means one who possesses, in addition to the purely mechanical trade knowledge craftsmanship of a journeyman plumber, a knowledge of plan making, plan reading and the ability to layout in the field plumbing installations for all occupancy classification.
         D.    Journeyman plumber means one who has learned the trade of plumber, and is so qualified as provided for in this chapter to work at such trades for or under the supervision of a master plumber.
      (2)    General.

         B.    Nothing in this chapter shall prohibit a general contractor not registered as herein provided from bidding upon or soliciting plumbing or steam fitting work in connection with the construction remodeling, alteration or repair of a building or premises provided that all such work is done under the supervision of a person registered to do such work as provided by this chapter.
         C.    No person, firm or corporation holding a certificate as provided herein shall loan or extend the right or privileges given thereunder for work contracted or done by any person other than the registrant or persons working under his direction or supervision and employed by his firm, and any violation thereof shall cause such certificate to be suspended or revoked as hereinafter provided.
