967.12 MEMORIALS.
   The City desires not to infringe on either dealers or the people using the cemetery; however, these rules were developed to protect both.
   It is the City's primary interest to make Willow Cemetery and North Oregon Cemetery a monument to the people in this community.
   (a)    General Memorial Rules: Monuments, Headstones, Markers And Corner Posts.
      (1)    No monument of any kind may be installed until full payment for the lot or space has been made to the cemetery.
      (2)    No wooden, iron or concrete crosses as memorials will be permitted.
      (3)    A.    The Superintendent must have approved by the Director of Public Service the drawings and specifications of any public vault before installation.
         B.    It should be expressly understood by the dealer that although sketches have been approved, the Director reserves the right at time of inspection to reject the work performed because of inferior workmanship or faulty material.
      (4)    The bottom of the base of every memorial shall be bedded true and level to allow every part of it to be in contact with the foundation.
       (5)    The Director reserves the right to remove any structure or object which is deemed objectionable.
      (6)    A.    A single space shall have one single marker.
         B.    A two-grave lot may have two singles or one double marker or monument.
         C.    A three-grave lot may have three singles or a double and a single or a triple marker or monument.
         D.    A four-grave lot may have a single marker, four singles, two doubles or a triple and single marker or monument.
         E.    In Section "I" of Willow Cemetery only, grave markers may be installed and they must be flush with the ground.
         F.    Markers and monuments must face the closest pathway.
      (7)    When a multiple marker refers to two or more burials, the position of the individual's name on the stone shall indicate the position of the burial.
      (8)    Guy posts or stakes may be driven into the ground under supervision of the Superintendent to assist in setting a monument and the dealer must pay all costs or damages which might occur.
      (9)    The use of a tree or monument for assistance in setting a monument is strictly prohibited.
      (10)    The cemetery is not liable for any misspelling of names, or the position of names on double markers and monuments.
   (b)    Material. Only guaranteed first grade approved material for memorials, such as marble, granite or bronze may be used.
   (c)   Dimensions. Size of memorials shall be subject to approval of the Director of Public Service to conform to the size and location of the lot.
      (1)    General care. The general care of the cemetery is assumed by the City under the supervision and direction of the Superintendent. It includes cutting the grass at reasonable intervals and the raking, cleaning and general maintenance of the grounds.
      (2)    Special Care Trust Fund. 
         A.    Lot owners desiring additional care of their lots may arrange with the cemetery office and deposit with the City Treasurer one hundred dollars ($100.00) per twelve-grave lot, whether occupied or unoccupied. The City Treasurer will deposit the sum in a Special Care Trust Fund from which the income will be used to defray the cost of such special care lots, which shall consist of straightening the headstones and care of such plantings and flowers and ground grooming which may be appropriate and within the income earned on the sum deposited in the Fund.
         B.    Special care provided by the establishment of a Fund, as above mentioned, shall be limited absolutely to the income received from the investments of the Fund, with no part of the principal being expended, anything herein that may be construed to the contrary notwithstanding.
         C.    For care of mausoleums and private vaults, see Section 967.11.
         D.    Lot owners must continue to pay $6.00 per 12-grave lot per year annual care on any lot sold before 1918 that at this time does not have Perpetual Care. All fees back to 1934 must be paid before burials can be placed on such lot.
      (3)    Self care.
         A.    Lot owners who wish to maintain and service their own lots and grave spaces may do so provided they make proper application at the cemetery office and sign an agreement that they will cut the grass and care for their flowers and plantings and keep shrubbery properly trimmed. They will be obliged to make a deposit of five dollars ($5.00) for the "Self Care" sign which will be forfeited if the Superintendent should find it necessary to remove the sign and cancel the permit because of failure on the part of the owner, in the judgment of the Superintendent, to keep his part of the agreement. In the event the permit is cancelled the lot will be placed under General Care and any plantings or flowers thereon not in compliance with cemetery rules governing lots under General Care will be removed.
         B.    Lots under Self Care are not subject to the general rules governing plantings, but are restricted to the use of good judgment and consideration of the area in which the lot is located. It is advisable to confer with the Superintendent before attempting any major improvement.
   (d)    Foundations. 
      (1)    All foundations shall be built by the cemetery. Violators of this rule shall be barred from further work in the cemetery.
      (2)    No foundations shall be poured between November 15 and April 1.
      (3)    The minimum depth of foundations shall be one and one-half feet for markers and three feet for monuments.
      (4)   After foundations are installed by the Superintendent, the office of the City Treasurer will bill the dealers.
      (5)   When a disinterment has been made, the memorial shall be removed and no allowance shall be granted for the foundation.
   (e)   Deliveries of Memorials.
      (1)   No delivery shall be made on Sundays or holidays, or after 4:00 p.m.
      (2)   Arrangements for delivery and erection of memorials shall be made so that there will be no interference with interments in nearby areas.
      (3)   No memorials shall be delivered between December 1 and April 1.
      (4)   Any exceptions must be made in writing, approved by the Director of Public Service.
   (f)   Memorial Planting or Memorial Gardens.
      (1)   All requests for memorial planting must be approved by the Director.
      (2)   Arrangements for donations and care of memorials can be made through the Director and approved by Council.
   (g)   Donations for Memorial Planting. Donations for memorial planting by individuals, groups or organizations are encouraged and desirable.
