929.21 SANITARY SEWER AREA CHARGES.
   There is hereby established a sanitary sewer area charge as follows:
   (a)    For Platted Residential Distriet Subdivisions. An area charge based on a rate per acre with a minimum one unit charge per parcel.
   (b)    For Other or Unplatted Land.
      (1)    For a parcel zoned R-1 or R-2 Residential District and up to three acres in size, a minimum charge of one unit and not to exceed a charge for one acre. The balance of the acreage will be deferred, if requested, until additional sanitary sewer service is needed at which time the charge will be in accordance with subsection (c) hereof.
      (2)    For a parcel zoned R-1 or R-2 Residential District and more than three acres in size, a minimum charge of two acres. The balance of the acreage will be deferred, if requested, until additional sanitary sewer service is needed at which time the charge will be in accordance with subsection (c) hereof. (Ord. 76-1983.       (3)    For a parcel zoned R-3, R-4 (PUD) or R-5 Residential District, an area charge based on a rate per acre times two and one-half with a minimum two and one-half unit charge. (Ord. 13-1990. Passed 1-22-90.)
      (4)    For a parcel zoned a Commercial District and/or Industrial District, the following area charges will apply:
         A.    Zoned C-1 District. An area charge based on a rate per acre with a minimum one-unit charge. Residential usage will allow a temporary connection to the sanitary sewer system and the area charge will be based upon subsection (b) (1) or (2) hereof, whichever is applicable. The balance of the acreage will be deferred, if requested, until additional sanitary sewer service is needed at which time the charge will be in accordance with subsection (c) hereof.
         B.    Zoned C-2 District. An area charge based on a rate per acre times one and one-half with a minimum one and one-half units charge. Residential usage will allow a temporary connection to the sanitary sewer system and the area charge will be based on subsection (b)(1) or (2) hereof, whichever is applicable. The balance of the acreage will be deferred, if requested, until additional sanitary sewer service is needed at which time the charge will be in accordance with subsection (c) hereof.

         C.    Zoned C-3, C-4 or C-5 District. An area charge based on a rate per acre times two and one-half with a minimum two and one-half units charge. Residential usage shall allow a temporary connection to the sanitary sewer system and the area charge shall be based upon subsections (b)(l) or (2) hereof, whichever is applicable. The balance of the acreage shall be deferred, if requested, until additional sanitary sewer service is needed at which time the charge shall be in accordance with subsection (c) hereof.
         D.   Zoned M-1, M-2 or Commercial-Industrial District. An area charge based on a rate per acre times two and one-half with a minimum two and one-half units charge. Residential usage shall allow a temporary connection to the sanitary sewer system and the area charge shall be based upon subsections (b)(1) or (2) hereof, whichever is applicable. The balance of the acreage shall be deferred if requested, until additional sanitary sewer service is needed at which time the charge shall be in accordance with subsection (c) hereof.

      (5)   For usage enumerated below, the following area charges apply:
         A.   For mortuaries, nursing homes, rest home or home for the aged, hospitals, or medical clinic and duplexes, an area charge based on a rate per acre with a minimum charge of one unit.
         B.   For airports and landing fields, cemeteries, open space recreation parks, open air theater, golf or country club, lodge or private recreation club or church, an area charge as follows:
For a 5/8 inch water meter, a lump sum of one acre;
For a 3/4 inch water meter, a lump sum of one and one- half acres;
For a 1 inch water meter, a lump sum of one and three- quarters acres;
For a 2 inch water meter, a lump sum of two acres; and
For a 3 inch water meter, a lump sum of four acres.
         C.   For gasoline or service station, automobile wrecking, scrap and junk yards including refinery or processing of automobile scrap or junk, mobile home parks, an area charge based on a rate per acre times one and one-half with a minimum charge of one and one-half units.
         D.   For usage that is governed by a conditional use permit, a special use permit or any other usage, the area charge shall be determined by legislation action of Council.
      (6)   For a parcel zoned an Agriculture District requiring residential service, an area charge based on a rate per acre with a minimum charge of two acres for the used or developed part of the Agriculture District. The balance of the parcel area charge will be deferred until additional sanitary sewer service is needed at which time the charge will be in accordance with subsection (c) hereof.

   (d)   At any time the usage of a parcel changes, if will be the owner’s responsibility to deposit with the City the charge applicable for that particular calendar year. The City will credit, at the then applicable charge, the previously paid charge for the year of new service.

   (e)   Parcel owners who maintain their residence on parcels that qualify for homestead exemption may, if they request, make application for a time payment plan. Any unpaid balance at year’s end shall have added interest of the unpaid balance, based on the finance interest of the applicable sewer district.

   (f)   Parcel owners may apply to Council for relief for easements given to public and quasi-public utilities.
   (g)   The sanitary sewer area charge established in this section shall be collected by the City at the time that an application is made for sanitary sewer service. Any additional sanitary sewer area charge, as set forth in this section because of a change in usage shall be collected by the City prior to the new permitted usage of the parcel or parcels in question.
   (h)   No refunds will be made for paid sanitary sewer area charges.
