929.01 DEFINITIONS.
   As used in this chapter:
   (1)    "Administrator" means the Administrator of the Environmental Protection Agency, or any person authorized to act for him.
   (2)    "Biochemical oxygen demand" or "BOD" means the quantity of oxygen utilized in the biochemical oxidation of organic matter under the standard laboratory procedure in five days at 20 degrees Centigrade.
   (3)    "City" means the City of Oregon, Ohio.
   (4)    "Combined sewer" shall mean a sewer intended to receive both wastewater and storm or surface water.
   (5)    "Cu. ft. " is an abbreviation for cubic feet.
   (6)   "Compatible pollutant" means a waste constituent which does not interfere with the operation or performance of the wastewater treatment works.
   (7)    "Debt service" means those amounts paid by each user connected or required to be connected to the sanitary sewer to pay capital charge requirements and capital expenditures to enlarge or improve the wastewater treatment works.
   (8)    "Director" means the Director of Public Service of the City or his authorized representative.
   (9)    "Environmental Protection Agency" means the Federal (or United States) Environmental Protection Agency, or any person authorized to act for that agency.
   (10)    "Incompatible pollutant" means a waste constituent which interferes with the operation and performance of the wastewater treatment works.
   (11)    "Industrial wastes" means the wastewater from industrial users, as defined herein.
   (12)    "Industrial user" or "industry" means any owner who discharges to the wastewater treatment works, liquid, solid or gaseous wastes resulting fromindustrial, manufacturing, trade or business process or from the development, recovery or processing by physical or chemical transformation of natural resources. Industrial users shall be billed monthly for the use of the treatment works.
   (13)    "Intercepting sewer" means a sewer intended to receive flows from both combined sewers and sanitary sewers; or a sewer whose primary purpose is to transport wastewater from collector (local) sewers to the wastewater treatment plant.
   (14)    "Lb. " is an abbreviation for pound.
   (15)    "Maintenance" means upkeep and repair costs required to maintain the wastewater treatment works structures and equipment in efficient operating condition during the service life of such works.
   (16)    "May" is permissive; "shall" is mandatory.
   (17)    "NPDES" or "National Pollutant Discharge Elimination System" permit means any permit or equivalent document or requirements issued by the State water pollution control agency to regulate the discharge of pollutant from the wastewater treatment works.
   (18)    "Nonindustrial user" means a user of the wastewater treatment works not in the "industrial user" classification, as defined herein.
   (19)    "Operation" means any physical and mechanical actions, processes or functions required to efficiently operate the wastewater treatment works as defined herein.
   (20)    "Owner" or "person" means any individual, firm, company, industry, association, society, corporation or group.
   (21)    "Phosphorus" means a constituent in wastewater as identified in "Standard Methods for the Examinationof Water and Wastewater".
   (22)    "Pollutant" means any noxious chemical or other refuse material or constituent that impairs the purity of water.
(23)    "Pretreatment" means the treatment of wastewater from sources before introduction into the wastewater treatment works.
   (24)    "Replacement" means expenditures for obtaining and installing equipment, accessories or appurtenances necessary to retain design capacity and performance of the wastewater treatment works throughout the City's jurisdiction,
   (25)    "Sanitary sewer" means a sewer that carries liquid and watercarried wastes from residences, commercial buildings, industries and institutions, together with minor quantities of ground, storm and surface water that are not admitted intentionally.
   (26)    "Sanitary sewer charges" means the aggregate of rate increments established by three separate revenue systems, i. e., user charges (charges for wastes of normal concentration and extra strength surcharges), debt service charges and capital improvements charges.
   (27)    "Sewer" means a pipe or conduit that carries wastewater or drainage water.
   (28)    "Storm sewer" means a sewer for conveying water, groundwater, subsurface water or unpolluted water from any source.
    (29)    "Suspended solids" means total suspended matter that either floats on the surface of, or is in suspension in, water, wastewater or other liquids and that is removable by laboratory filtering as prescribed in "Standard Methods for the Examination of Water and Wastewater" and referred to as nonfilterable residue.
   (30)    "User charge" means a charge levied on users of the wastewater treatment works for the cost of operation and maintenance of such works.
   (31)    "Wastewater" or "wastes" means the spent water of a community. From the standpoint of source, it may be a combination of the liquid and water-carried wastes from residences, commercial buildings, industries and institutions, together with any groundwater, surface water and stormwater that may be present.
   (32)   "Wastewater treatment plant" or "plant" means that portion of the wastewater treatment works required to treat wastewater and dispose of the effluent.
   (33)    "Wastewater treatment works" or "works" means the structures, equipment, parcels of land, easements and processes required to collect, carry away and treat wastewater and dispose of the effluent of the City. Wastewater treatment works shall include sanitary sewers and intercepting sewers, but shall not include storm sewers.

   (34)    "Normal domestic sewage" means the wastewater discharged by residential users of the treatment works or water carried wastes originating from sanitary conveyances. Domestic wastes do not include trade or process waters. Normal domestic waste is further defined as the normal concentrations of wastes as outlined in Section 929.02.
