927.99 PENALTY.
   (a)    Administrative Fines. Notwithstanding any other section of this chapter, any discharger who is found to have violated any provision of this chapter or permits or orders issued hereunder shall be fined in an amount not to exceed one thousand dollars ($1,000) per violation. Each day on which noncompliance occurs or continues shall be deemed a separate and distinct violation. Such assessments may be added to the discharger's next scheduled sewer service charge and the Director shall have other collection remedies as he has to collect other service charges.
   Unpaid charges, fines and penalties shall constitute a lien against the individual discharger's property. Industrial dischargers desiring to dispute such fines shall file a request for the Director to reconsider the fine within ten days of being notified of the fine. Where the Director believes the request has merit, he shall convene a hearing on the matter within fifteen days of receiving the request from the discharger.
   (b)   Civil Penalties. Any discharger who is found to have violated an order of the City or who has failed to comply with any provision of this chapter or the wastewater discharge permit, and the regulations or rules of the City, or orders of any court of competent jurisdiction may be subjected to the imposition of a fine in an amount not to exceed one thousand dollars ($1,000). Each day on which a violation occurs or continues shall be deemed a separate and distinct offense. In addition to the penalties provided herein, the City shall recover costs for legal counsel, court costs, court reporter's fees and other expenses of litigation by appropriate suit at law against the person found to have violated this chapter, or the wastewater discharge permit, or the orders, rules, regulations and permits issued hereunder.
