521.12 OBSTRUCTING A WATERCOURSE.
   (a)   No person by construction or maintenance of a driveway or otherwise shall, except with the permission of Council, block, or obstruct any public sewer, gutter, ditch, drain or watercourse along, upon or across a public street, public way or public ground within the City.
   (b)   The Mayor or Chief of Police by written notice to the party or parties responsible therefor may order any such blockage or obstruction caused, created or maintained by the owner or occupant of any property abutting such blockage or obstruction to be removed and proper drainage in such sewer, gutter, ditch, drain or watercourse to be restored. In the event such owner or occupant fails, neglects or refuses so to do for a period of fifteen days after delivery of such notice, the Mayor or Chief of Police may, with the permission of the owner of such premises and at the expense of such owner, or at the direction of Council, remove such blockage or obstruction and restore such drainage in accordance with rules and regulations established in this section.
   (c)   The Mayor or Chief of Police is hereby authorized to adopt, promulgate, amend and enforce such administrative rules and regulations as may be necessary to execute and enforce the provisions of this section and is further specifically authorized and empowered to fix and establish by such rules and regulations the grade, materials, and specifications of drainage structures to be installed, altered or repaired within the limits of any public street and the manner of performing any work relating thereto. Such rules and regulations shall be approved by Council and after such approval be kept on file and open to public inspection in the offices of the Mayor or Chief of Police.
   (d)   In addition to the procedures and remedies otherwise provided in this section, proceedings may be had as set forth in Ohio R.C. Chapter 729.
   (e)   Whoever violates any provision of this section or any reasonable rule or regulation established by the Mayor or Chief of Police pursuant hereto is guilty of a minor misdemeanor. Each thirty day period that any blockage or obstruction of any sewer, gutter, ditch, drain or watercourse is permitted to continue after order by the Mayor or Chief of Police or Council to remove or correct the same shall be deemed a separate offense.
