In the event that the Mayor, or in his absence the President of Council, or in the absence of both the Mayor and President of Council, the Chief of Police finds it necessary in order to preserve the public safety and good order of the community in times of public crises, riots and civil disturbances, he may declare and establish a curfew prohibiting the physical presence of anyone upon the public streets, parks and public places of the City.
(a) In the event the Mayor, President of Council or the Chief of Police deems it necessary to issue a curfew order, he shall do so by issuing a proclamation setting forth the time and the circumstances of such curfew order, the ages of persons to be subject thereto, and shall publish the proclamation by use of the newspapers, radio and television facilities of the community to residents of the City.
(b) In the event the Mayor, President of Council or the Chief of Police deems it necessary to issue a curfew order, any police officer of the City, or any other peace officer acting under the direction of the Mayor, President of Council or the Chief of Police or any other duly authorized agent, shall have the right to stop any person subject to the curfew found upon the streets or public places of the City within the hours of curfew and to inquire of the person proof of his age, his destination and purpose for being upon the public streets and public ways of the City to determine if the person is subject to the curfew.
(c) Whoever violates this section is guilty of a misdmeanor of the first degree.
