(a) From the time a resident places recyclables in an approved City recycling container at the streetline in accordance with the terms hereof, such recyclable items shall become the property of the City. It shall be a violation of this chapter for any person unauthorized by the City to collect or pick up or cause to be collected or picked up any such items and such collection or pickup in violation hereof from any location shall constitute a separate and distinct offense, punishable as hereafter provided.
(b) Whoever violates this provision is guilty on the first offense of a minor misdemeanor. Whoever violates this provision on the second offense is guilty of a misdemeanor of the first degree.
