77.01 PURPOSE.

The City Council hereby determines that restrictions for the operation and use of roller-skates, skateboards, and scooters within the downtown Central Business District of the City is necessary and proper for promoting public safety and protection of property, all for the common good.

77.02 DEFINTIONS.

1.   “Downtown Central Business District” means the area of the City bounded by the following streets:

   A.   East: Alley between Albany and Boston

   B.   South: South 3rd Street

   C.   West: Arizona Avenue

   D.   North: North 4th Street

2.   “Electric scooter” means an electrically driven scooter equipped with two or more wheels and designed so that the rider or operator stands on the vehicle while the same is in motion and having a top attainable speed of less than 25 MPH.

3.   “Motorized scooter” means a motor driven scooter equipped with two or more wheels and designed so that the rider or operator stands on the vehicle while the same is in motion and having a top attainable speed of less than 25 MPH.

4.   “Operator” means a person who operates or is in actual control of a skateboard, roller skates, or scooter.

5.   “Roller skates” means a shoe with wheels attached or a device with wheels which is designed to be attached to a shoe and commonly known as “roller skates” or “in-line skates.”

6.   “Scooter” means a motor driven or non-motor driven scooter equipped with two or more wheels and designed so that the rider or operator stands on the vehicle while in motion and having a top attain able speed of less than 25 MPH.

7.   “Skateboard” means a wheeled device designed to transport a rider in a standing position, which device is not otherwise secured to a rider’s feet or shoes.
