(a) The Mayor be and is hereby authorized and directed to negotiate a reasonable rental fee for any telecommunication facilities which is to be located in the Village’s right-of-way and which are to be installed after the effective date of this ordinance. All such fees shall be subject to the review and approval by Council, which approval may be by motion.
(b) In determining a reasonable rental fee, pursuant to subsection (a) hereof, the Mayor and Council shall consider the size of the telecommunication facilities, the number of telecommunication facilities to be located in the rights-of-way, the expected maintenance requirements of the telecommunication facilities to be located in the rights-of-way, the likelihood that traffic will be impacted by the location of the facilities in the rights-of-way, the likelihood that the facilities will be used by Orange Village residents or employees, and any other factors which the Mayor and Council deem relevant in relation to the specific facilities to be installed in the rights-of-way. In making their determinations of the reasonable rental rates, the Mayor and Council shall consider any prior fees charged and or collected by the Village for uses of the Village’s rights-of-way.
