(a) Number of Trees Required. Any owner or builder of a house shall be required to have one shade tree planted, by the Village, for each multiple of thirty feet to fifty feet of frontage, depending upon the tree lawn and the type of tree to be planted, as determined by the Service Director in his sole discretion. A minimum of one shade tree shall be planted for each house or other building, regardless of the frontage of the lot.
(b) Deposit; Issuance of Building Permit. Any owner or builder of a house or other building which is constructed and erected within the Village shall deposit, with the Village Treasurer, two hundred fifty dollars ($250.00) per tree required by subsection (a) hereof to the expenses incurred by the Village for the planting of shade trees on the tree lawn abutting such house or other building. The Building Commissioner shall not issue a building permit to any person engaged in the construction of such house or building until this deposit is made.

(c) Death or Destruction of Tree. Except for trees that are destroyed by the negligent or intentional behavior of a person or persons, who are then held responsible for the replacement of such trees, in the event a tree planted pursuant to subsection (a) hereof dies or is destroyed, the Village shall plant another tree of similar size, quality and value within six months of the death or destruction of the original tree.

(d) Exempt Zoning Districts. This section does not apply to the U-2 Detached and Attached Single Family Home Districts or uses.
