(a) No occupancy permit for a new dwelling or new dwelling unit, the permit for which was issued after September 5, 2007, shall be issued unless smoke detectors and carbon monoxide (CO) detectors, as required herein, have been installed in proper locations and have been demonstrated to be properly operating.
(b) No Certificate of Inspection, as required by Chapter 1337 of these Codified Ordinances, shall be issued after the effective date of this chapter, unless carbon monoxide (CO) detectors, as required herein, have been installed in proper locations and have been demonstrated to be properly operating.
(c) Compliance with this section shall be the responsibility of the owner of the dwelling or dwelling unit who may designate an individual for this purpose by providing the Building Department, in writing, the name and address of such agent.
(d) The Building Department shall be charged with the responsibility of enforcing this section only during the course of routine housing inspections, during the course of Point of Sale Inspections, or when specifically or actually informed of a violation of this section. Neither the Village nor any of its employees shall be held responsible for any death, personal injury or property damages suffered by reason of any failure to comply with this section.
(e) This section shall not be construed to relieve any person, firm or corporation from any obligation otherwise imposed by it or other ordinances, regulations or statutes including, but not limited to, building and/or fire codes applicable to any structure.
