(a) Each dwelling unit for the construction of which application for a permit is made on or after the effective date of this section and where a sanitary sewer is available for use, shall, prior to the occupation thereof for residence purposes, be equipped with a properly installed mechanical garbage disposal which conforms to Section 1367.04.
(b) Each building or place, other than a dwelling unit, the construction or equipment of which is commenced on or after the effective date of this section and where a sanitary sewer is available for use, shall, prior to the occupancy or use thereof for any purpose which results in the production of garbage, be equipped with a properly installed mechanical garbage disposal which complies with Section 1367.04.
