The Building Commissioner shall refuse to issue a permit for an artificial pond or lake if he or she determines that any such pond or lake would constitute a safety or health hazard, create a private or public nuisance or tend to become stagnant or noisome by reason of inadequate water supply for drainage. Such refusal shall be made in writing and the reasons for the refusal shall be stated and submitted to the applicant. The permit or refusal shall be issued within thirty days of the date of the application and if the Building Commissioner fails to act within that period, the applicant may proceed with the installation or construction of the pond or lake without a permit.
