937.03 FALSE ALARM CHARGES.
   (a)   False alarm charges shall be made as follows:
      (1)   Residential users. No charge shall be made for the first three false alarms in a calendar year. A charge of ten dollars ($10.00) shall be made for the fourth false alarm made in a calendar year and a charge of twenty-five dollars ($25.00) shall be made for each false alarm thereafter for the rest of the calendar year for each additional false alarm thereafter in the same calendar year.
      (2)   Business users. No charge shall be made for the first three false alarms in a calendar year. A charge of fifty dollars ($50.00) shall be made for the fourth false alarm made in a calendar year and for each additional false alarm thereafter in the same calendar year.
   (b)   Residential and business false alarm charges shall apply when the Police Department or the Fire Department receives a call to respond to a property because an alarm on the property has been triggered and there is no actual emergency condition which necessitates an emergency response. The determination of whether an alarm is a “false alarm” shall be made by the Police Chief or Fire Chief, subject to review by the Mayor.
