(a) No person shall remove topsoil or loam for commercial purposes from any property within the Municipality, except only so far as is necessary for the erection, construction or alteration of buildings, the installation of driveways, the landscaping of property or the installation or construction of a pond, lake or other improvement.

(b) Whoever violates this section is guilty of a misdemeanor of the fourth degree.
