123.01 REPRESENTATION IN EMERGENCY.
   (a)   In an emergency, or when time is otherwise of the essence, the Law Director is authorized and directed to defend or prosecute any action on behalf of or taken against the Village by immediately supplying legal services for the Village, but only when such defense or prosecution is requested by at least three Council persons, one of which shall be the President of Council, or, in his absence or unavailability, the President pro tem of Council.
   (b)   The Council persons requesting action of the Law Director shall determine when an emergency exists or when time is otherwise of the essence.
   (c)   Prior to taking any action, the Law Director, in his discretion, may require such request to be delivered to his office in the form of a signed writing.
   (d)   Council shall approve or disapprove of the continuation of the requested defense or prosecution at the next Council meeting following such request, or at any special or emergency Council meeting called to discuss such action.
